Presenting the main principles as well as the fundamental rules of Polish constitutional law and its relationship with European law, this book allows to discover and understand the specificities of the constitutional history of Poland within the European Union. Its reading is indispensable for understanding the constitutional dynamics accompanying European construction in this state and for grasping the political and legal culture that is unique to Poland. The author approaches Polish constitutional law from a historical, institutional, normative and jurisprudential perspective. Structured in four chapters, the book deals with the essential themes of constitutional law such as power, norms, justice and fundamental rights. In keeping with the characteristics of this Collection, each chapter is devoted to developments in the European field, thus opening up the study of constitutional law to the specific challenges of the European Union.

This open access book explores the legal aspects of cybersecurity in Poland. The authors are not limited to the framework created by the NCSA (National Cybersecurity System Act - this act was the first attempt to create a legal regulation of cybersecurity and, in addition, has implemented the provisions of the NIS Directive) but may discuss a number of other issues. The book presents international and EU regulations in the field of cybersecurity and issues pertinent to combating cybercrime and cyberterrorism. Moreover, regulations concerning cybercrime in a few select European countries are presented in addition to the problem of collision of state actions in ensuring cybersecurity and human rights. The advantages of the book include a comprehensive and synthetic approach to the issues related to the cybersecurity system of the Republic of Poland, a research perspective that takes as the basic level of analysis issues related to the security of the state and citizens, and the analysis of additional issues related to cybersecurity, such as cybercrime, cyberterrorism, and the problem of collision between states ensuring security cybernetics and human rights. The book targets a wide range of readers, especially scientists and researchers, members of legislative bodies, practitioners (especially judges, prosecutors, lawyers, law enforcement officials), experts in the field of IT security, and officials of public authorities. Most authors are scholars and researchers at the War Studies University in Warsaw. Some of them work at the Academic Centre for Cybersecurity Policy  - a thinktank created by the Ministry of National Defence of the Republic of Poland. 

This book focuses on an emerging problem in English contract law: what should be done when a party has been unjustly enriched as the result of a breach of contract but there is no measurable loss suffered by said party? Two rulings are at the heart of the book: Wrotham Park Estate v Parkside Homes and Attorney-General v Blake. These two cases can be said to have established gain-based remedies in English contract law. However, the principles that underpin these remedies are not entirely clear and are subject to debate. This book analyses these principles through the lens of compensatory and restitutionary approaches. Moreover, it applies a comparative analysis of these approaches through the lens of the civil law jurisdiction in Poland. Since the term 'compensation' is not a universal concept, the book distinguishes between two rationales in the compensatory analysis. The first, reparative compensation, is defined as a form of monetary recompense for loss or damage actually suffered. The second, substitutive compensation, represents a monetary equivalent to a right that a person has been deprived of or denied. Both rationales require the application of a broad notion of loss in order to make gain-based remedies workable in both English and Polish law. In contrast, 'restitution' states that a person cannot be permitted to profit from their own wrongdoing. Based on this principle, the book argues that gain-based remedies could be applied under Polish law through the rules of unjust enrichment. However, in order to do so, a broader understanding of the subtraction prerequisite (the enrichment being at the aggrieved party's expense) would have to be adopted. The book concludes that unjust enrichment is a more natural way of implementing gain-based remedies in civil law jurisdictions.

This book reveals how decisions regarding where to migrate are made, what factors are considered, how these change over time and why some destinations are more attractive to certain categories of people. Based on rich existent, and new data, the book explains the destination choices of Polish migrants to the four most frequently chosen destinations countries: the UK, Ireland, Germany and the Netherlands. Examined through a sophisticated theoretical framework allowing for the incorporation of factors resulting from several fields - economics, public policies, demography - and migration theories, it paints a nuanced and balanced picture of European migration.

The book presents good practices in humanitarian assistance and empowerment of Ukrainian refugees in various areas: emergency aid to large groups crossing the border, organisation of support in places of temporary stay, learning local languages, inclusion of children in school and adults in the labour market, and inclusion in the local community. It indicates the forms of international protection and the scope of their application by migrants from Ukraine, and discusses the temporary protection status dedicated to Ukrainian refugees. The volume will be of great interest to scholars and researchers of migration and diaspora studies, immigration law, and public policy.

This book provides a new analytical perspective on the strategies, membership and communication management of political parties in Poland. The authors address why some political parties have managed to strengthen and survive while others have failed to do the same. The research was carried out in the years 2016-2018, when Poland started to be seen more and more as a weakening democracy. As an in-depth, empirically grounded single-country study of party structure and communication, the book gives an opportunity to draw broader conclusions about the process of party development in the Central and Eastern Europe region three decades since the beginning of democratic transition.

This book explores the political, economic, defence, and cultural relations of Poland with South Asia--Afghanistan, Bangladesh, Bhutan, India, Myanmar, Nepal, Pakistan, and Sri Lanka--since the late 1940s to the present. It examines how Polish preoccupation with gaining admission to NATO and the European Union led South Asia to fade into the margins of Polish foreign policy. This book provides new and original insight on the senior living housing needs in Poland. It focuses on housing needs of the 60-74 age group that are generally more mobile and not in need of services offered in care homes. This edited volume analyses and discusses the systematisation of Polish socio-economic transformations of the last three decades using selected examples of the most important changes.  1989 marked the onset of the political transformation process in Poland and other countries of Central and Eastern Europe. The transition involved a shift from a socialist system to a parliamentary democracy and from a command economy to a market one. Due to the deep economic crisis that culminated in 1988 and the peaceful model of change developed and implemented in Poland, the magnitude and manner of implementing various initiatives was unprecedented and had specific implications. This transformation opened Polish society and the Polish economy to the impact of global social and economic changes, triggering successive transformations, often overlapping in terms of their causes and consequences. This publication aims to present the course and effects, in particular territorial, of Poland's socio-economic transformation in the years 1990-2020. The analysis covers the key aspects of this transformation, illustrated with references to the concepts and theories of development, domestic and foreign literature, own empirical research and existing or newly developed model approaches to transformation in the territorial dimension.
