- The Schuman Plan: the first step to European unity and the first European antitrust law

Le 9 mai 1950 le ministre des Affaires Etrangères français, Robert Schuman, présentait à l'Assemblée Nationale française, et en effet au monde entier, un memorandum, le Plan Schuman, qui prévoyait la création d'une Communauté européenne du Charbon et de l'Acier. Une Conférence diplomatique fut convoquée à Paris, le 20 juin 1950, pour étudier le projet et le réaliser. Le problème le plus difficile à résoudre regardait la législation antitrust. Le plan antitrust et deux articles spécifiques à cet égard (art. 65-66), qui avaient été rédigés par Robert R. Bowie, furent inscrits dans le Traité après une longue négociation. Il s'agissait pour l'Europe d'une innovation fondamentale, qui fut ensuite à la base de la législation antitrust du Marché commun.

Jean Monnet, the head of the French delegation at the talks held in Paris, insisted on the ‘deconcentration’ of the steel and coal industries. Steel companies would be compelled to dispose of the colleries which they owned. To do this, however, Monnet had to invoke the help of the American high commissioner in Germany, John J. McCloy and his expert advisers. In terms of its origins the Coal and Steel Community can be considered the product of a bargain struck between the Federal Republic and America, not France and Western Germany.
